1. ACCEPTANCE OF TERMS
The following Terms and Conditions of Use (the "Agreement") constitutes an agreement between you ("You") and SECRETDREAMER, operator of www.secretdreamer.co.uk (the "Site"). By using the Site, you agree to be bound by and accept the terms of this Agreement.
2. MODIFICATIONS TO THIS AGREEMENT
SECRETDREAMER reserve the right, at our sole discretion, to change, modify or alter these terms and conditions of this Agreement at any time. Such modifications shall become effective immediately upon posting. This entire Agreement dated February 10th, 2010 supersedes all prior agreements, understandings, or representations with respect to the terms and use of this site. This Agreement may not be modified or amended except as expressly agreed in writing signed by an authorized agent of SECRETDREAMER.
3. WEBSITE CONTENT
The Site contains videos, images, animations, flash objects, buttons, special effects, and any other audio/video content recorded in any format ("Digital Media Files"), owned by SECRETDREAMER available for licensed use under the terms of SECRETDREAMER LICENSE AGREEMENT. The Digital Media Files are the properties of SECRETDREAMER and/or its licensors.
Other Non Digital Media Content on the Site is the property of SECRETDREAMER. SECRETDREAMER makes its best efforts to ensure the accuracy of the other content on the Site, but makes no warranties or representations, nor shall be liable for any damages arising from, any inaccuracy of other content on the Site.
4. THIRD PARTY CONTENT, OFF-SITE LINKS, AND SERVICES
The site may contain third party content, offsite links and services that links to the World Wide Web content which is not part of the Site. You agree and acknowledge that SECRETDREAMER is not responsible for such Content.
5. PRIVACY POLICY

(I) Not to use any spider, scraper, robots or any other automated means to access the Site for any purpose without SECRETDREAMER express written permission.
(II) Not to take any action that imposes, or may impose in SECRETDREAMER sole discretion, an unreasonable or disproportionately large load on SECRETDREAMER servers or other infrastructure or to interfere or attempt to interfere with the proper operation of the Site or any activities conducted on the Site.
(III) Not to copy, reproduce, modify, create derivative works from, distribute or publicly display any Media from the Site, including but not limited to "framing" Site Media within another site, except that you may use Digital Media Files validly licensed by SECRETDREAMER to You under SECRETDREAMER LICENSE AGREEMENT.
(IV) To use the Site only for lawful purposes, and to comply with all applicable laws and regulations in connection with your use of the Site.
(V) Not to advertise products or services or solicit any user of the Site, whether or not such advertising or solicitation is in the form of unrequested bulk commercial email.
7. TERMINATION OF USE
SECRETDREAMER may at its sole discretion terminate or limit your use of the Site for violation of any of the rules contained in this Agreement, or for any conduct, whether by act or omission, which in SECRETDREAMER's sole opinion adversely impacts the operation of the Site. SECRETDREAMER may so terminate or limit your use of the Site without prior notice to you. If such termination or limitation is for reasonable cause, SECRETDREAMER will not be obligated to refund any fees paid by you.
8. INTELLECTUAL PROPERTY
"SECRETDREAMER" and www.secretdreamer.co.uk are trademarks of Select Publishing Group. All content on this Site and Site layout are copyright by SECRETDREAMER. The visual appearance of the Site is protected trade dress of SECRETDREAMER Copyrights
9. DISCLAIMER OR WARRANTIES
SECRETDREAMER HEREBY WAIVES ALL WARRANTIES EXPRESS AND IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR AN INTENDED USE, IN CONNECTION WITH THE SITE.
10. LIMITATIONS OF LIABILITY
IN NO EVENT WILL SECRETDREAMER OR ITS AFFILIATES, SUPPLIERS AND LICENSORS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, ECONOMIC, COVER, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE DIGITAL MEDIA FILES, WITHOUT LIMITATION, DAMAGES OR COSTS RELATING TO THE LOSS OF PROFITS, BUSINESS, GOODWILL, DATA, TIME OR COMPUTER PROGRAMS, COMPUTER HARDWARE OR CD-ROM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL SECRETDREAMER AND ITS AFFILIATES’, SUPPLIERS’ AND LICENSORS’ LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE DIGITAL MEDIA FILES REGARDLESS OF THE FORM OF THE CLAIM (INCLUDING, WITHOUT LIMITATION, ANY CONTRACT, PRODUCT LIABILITY, OR TORT CLAIM). BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
ENTIRE AGREEMENT. This entire Agreement dated February 10th, 2010 supersedes all prior agreements, understandings, or representations with respect to the Digital Media Files. This Agreement may not be modified or amended except in a writing signed by you and SECRETDREAMER.
